3. Definitions
3.1 “Personal data” means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
3.2 “Special categories of personal data” are data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.
3.3 In all other respects, the (further) definitions of Art. 4 GDPR apply.
4. Cookies
The operator of the website or the software installed on the server uses cookies. Cookies are data that are stored by the Internet browser on the user’s computer system. Cookies can be transmitted to a website when it is accessed and thus enable the user to be identified. Cookies help to simplify the use of websites for users by enabling extended functionalities (such as the elimination of the need to enter a password). 6. Registrierung auf unserer Website und Nutzerdaten
6.1 For technical reasons, the software on our website stores all information that you transmit to us via forms. This applies in particular, but not exclusively, to links, posts and comments in the forum and blogs, nicknames, e-mail addresses, passwords and other information and content that you knowingly and intentionally transmit. Passwords are stored by us in coded form and cannot be viewed by us or third parties without abusive or unlawful actions.
6.2 Full and active use of the forum requires free registration. Registration requires the mandatory provision of the following personal data:

This information is used for personalization, identification and verification (appropriate contact and protection against misuse), the activation of portal functions, contact on specific occasions and statistical surveys in order to optimize the online offering accordingly. The processing of this registration data is necessary to safeguard our legitimate interests and to provide our offers and services.
The following information can be provided voluntarily during registration:

This information is used for statistical purposes to optimize the online offering or to provide user-optimized content, and optionally for publication in the user profile after active approval by the user or personal member.
No sensitive personal data is collected or otherwise processed.
6.3 The user/nickname you have chosen, your e-mail address, your password and your forum posts are transmitted to our cooperation partner IndustryArena LLC, which operates the CNCzone portal and processes the data accordingly in the USA. This serves not only your but also our legitimate interests. The purpose is to ensure that the use of a user/nickname you have chosen on both portals is reserved exclusively for you personally and that misuse (unauthorized multiple personal memberships) is prevented.
6.4 Your registration data will be stored exclusively on servers within the EU, apart from their transmission to our cooperation partner IndustryArena LLC and data processing by the latter. The servers on which the databases are operated are operated by service providers on behalf of and under the strict instructions of the controller.
6.5 With regard to the transfer of the aforementioned data to our cooperation partner IndustryArena LLC and the data processing by the latter in the USA, it should be noted that there is no level of data protection there that is equivalent to that within the EU (no adequate level of data protection). In particular, there are extensive sovereign access rights for various purposes. However, we have ensured a comparable level of data protection through contractual regulations (EU standard data protection clauses).
6.6 We also need the data you provide during the registration process in order to be able to contact you in response to a request or for any other reason. In addition, the information on your professional function and role in particular allows us to obtain an overview of our membership structure. This enables us to manage our information and advertising offers to you and our partners in an interest-oriented manner.
6.7. Ad
When you register or create a user account, you have the option of subscribing to postal or electronic advertising offers. This is done on the basis of your express and voluntary consent. This consent can be revoked at any time with effect for the future without giving reasons. The revocation must be sent to us via the ticket system.
6.8 Registration is carried out using a double opt-in procedure to protect against misuse or confusion: a confirmation link is sent to the e-mail address provided. Registration is only complete once this has been activated.
6.9 Users have the option to have the stored data deleted, changed or corrected at any time. Users can obtain information about their stored personal data at any time. Settings (profile settings and basic settings) can be made in the member account to determine whether and, if so, which personal data can be viewed via the portal. The default setting is “not public”.
7. Transfer of data to third parties
7.1 As a general rule, personal user data will never be passed on to third parties, sold or made accessible to them in any other way, whether for payment or free of charge.

8. Data security on the Internet

Complete protection of data against access by third parties is not possible. However, we assure you that we take all reasonable measures available to us to prevent such criminal activities.
9. Contact options
You can easily contact us at any time via our ticket system. If you contact us via this system, the personal data you provide will be stored automatically. The data is stored solely for the purpose of processing or contacting you. The data will not be passed on to third parties.
10. Integration of YouTube videos
10.1 We have integrated YouTube videos into our website, which are stored on http://www.YouTube.com and can be played directly from our website. These are all integrated in “extended data protection mode”, i.e. no data about you as a user is transferred to YouTube if you do not play the videos. Only when you play the videos will the data mentioned in paragraph 2 be transmitted. We have no influence on this data transfer. The integration of YouTube videos serves to increase the attractiveness of our website (legitimate interest) and is part of the service that we provide for our customers (contract performance).
10.2 By visiting the website, YouTube receives the information that you have accessed the corresponding subpage of our website. In addition, the data mentioned in section 3 of this declaration will be transmitted. This occurs regardless of whether YouTube provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data will be assigned directly to your account. If you do not wish your data to be associated with your YouTube profile, you must log out before activating the button. Google also processes your personal data in the USA and has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.
11. Deletion and blocking of personal data
11.1 We process and store personal data of the data subject only for as long as is necessary to achieve the purpose of storage. Data may be stored beyond this period if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject.
11.2 As soon as the storage purpose no longer applies or a storage period prescribed by the aforementioned regulations expires, the personal data will be routinely blocked or deleted.
12 .Rights of the user (data subject)
If your personal data is processed, you are considered a data subject within the meaning of the GDPR. As the data controller, we grant you the following rights:
12.1. Right to Access 12.1.1. You may request confirmation from us as to whether personal data concerning you is being processed. If such processing exists, you may request the following information from the controller:
The purposes for which the personal data is processed;
The categories of personal data being processed;
The recipients or categories of recipients to whom the personal data concerning you has been or will be disclosed;
The planned storage period for your personal data, or if specific information is not available, criteria for determining the storage period;
The existence of a right to rectification or erasure of personal data concerning you, the right to restriction of processing by the controller, or the right to object to such processing;
The existence of a right to lodge a complaint with a supervisory authority;
All available information about the origin of the data if the personal data was not collected from the data subject;

12.1.2. You have the right to request information about whether your personal data is transferred to a third country or an international organization. In this regard, you may request to be informed about the appropriate safeguards pursuant to Article 46 GDPR in connection with the transfer.
12.2. Right to Rectification You have the right to request rectification and/or completion from us if the personal data being processed concerning you is incorrect or incomplete. We must correct the data without undue delay.
12.3. Right to Restriction of Processing 12.3.1. Under the following conditions, you may request the restriction of processing of your personal data:
If you dispute the accuracy of your personal data, for a period enabling us to verify the accuracy of the personal data;
If the processing is unlawful and you oppose the deletion of the personal data and instead request the restriction of its use;
If we no longer need the personal data for processing purposes, but you need it for the establishment, exercise, or defense of legal claims;
If you have objected to processing pursuant to Article 21(1) GDPR and it has not yet been determined whether our legitimate interests outweigh your interests.
12.3.2. If the processing of your personal data has been restricted, such data – apart from being stored – may only be processed with your consent or for the establishment, exercise, or defense of legal claims, or for protecting the rights of another natural or legal person, or for reasons of significant public interest of the Union or a Member State.
12.3.3. If the restriction of processing is lifted under the above conditions, you will be informed before the restriction is removed.
12.4. Right to Erasure 12.4.1. You may request that we erase personal data concerning you without undue delay, provided that one of the following reasons applies:
The personal data concerning you is no longer necessary for the purposes for which it was collected or otherwise processed;
You withdraw your consent on which the processing was based pursuant to Article 6(1)(a) or Article 9(2)(a) GDPR, and there is no other legal basis for the processing;
You object to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or you object to processing pursuant to Article 21(2) GDPR;
The personal data concerning you has been processed unlawfully;
The deletion of your personal data is required to comply with a legal obligation under Union or Member State law to which we are subject;
The personal data concerning you was collected in relation to the offer of information society services pursuant to Article 8(1) GDPR.
12.4.2. If we have made your personal data public and we are obligated to erase it under Article 17(1) GDPR, we will take reasonable measures, including technical measures, considering available technology and implementation costs, to inform other controllers processing the personal data that you have requested the deletion of all links to, copies, or replications of your personal data.
12.4.3. The right to erasure does not exist to the extent that processing is necessary:
For exercising the right to freedom of expression and information;
For compliance with a legal obligation that requires processing under Union or Member State law to which we are subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in us;
For the establishment, exercise, or defense of legal claims.
12.5. Right to Notification 12.5.1. If you have exercised your right to rectification, erasure, or restriction of processing, we are obliged to inform all recipients to whom your personal data has been disclosed about this rectification, erasure, or restriction of processing unless this proves impossible or involves a disproportionate effort.
12.5.2. You have the right to be informed about these recipients.
12.6. Right to Data Portability 12.6.1. You have the right to receive the personal data that you have provided to us in a structured, commonly used, and machine-readable format.
12.6.2. You also have the right to transmit this data to another controller without hindrance from us, provided that:
The processing is based on consent pursuant to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR or on a contract pursuant to Article 6(1)(b) GDPR; and
The processing is carried out by automated means.
12.7. Right to Object 12.7.1. You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data pursuant to Article 6(1)(e) or (f) GDPR, including profiling based on these provisions.
12.8. Right to Withdraw Consent You have the right to withdraw your consent to data processing at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
12.9. Right to Lodge a Complaint with a Supervisory Authority 12.9.1. Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, particularly in the Member State of your residence, workplace, or the place of the alleged infringement, if you believe that the processing of personal data concerning you violates the GDPR.
12.10. Legal Bases for Processing Personal Data 12.10.1. If we obtain the consent of the data subject for processing personal data, Article 6(1)(a) GDPR serves as the legal basis. 12.10.2. If the processing of personal data is necessary for the performance of a contract to which you are a party, Article 6(1)(b) GDPR serves as the legal basis. 12.10.3. If processing is necessary to fulfill a legal obligation, Article 6(1)(c) GDPR serves as the legal basis. 12.10.4. If processing is necessary to protect vital interests, Article 6(1)(d) GDPR applies. 12.10.5. If processing is necessary for our legitimate interests or those of a third party, provided your interests do not override these, Article 6(1)(f) GDPR serves as the legal basis. Our legitimate interest lies in offering our services.
13. Amendment Clause of this Privacy Policy
This Privacy Policy is current as of January 2020.
The further development of our website or specific areas of it, changes to our services and offerings, or modifications in legal requirements may necessitate an update to this Privacy Policy. We will notify you of any such changes.
